Can you help with payday loans?
Most of the time, yes. Your advisor can provide more information based on your individual case.
How do I know if I’m eligible for an IVA?
Eligibility can vary on a case-by-case basis. But if you live in England or Wales and have over £6,000 of unsecured debts from a minimum of two creditors, you may be eligible.
I’m Scottish but want an IVA, what can I do?
An IVA is only available to residents in England & Wales however there is a similar option available in Scotland called a Protected Trust Deed.
How do I qualify for a debt management plan?
You must be a resident of the UK, be in over £1,000 of debt owing to 2 or more creditors, and have at least £80 in monthly disposable income.
What happens once I’ve filled in the form online?
When we receive your form, one of our advisors will call you. If you’re not able to speak at this point, they will arrange a further date and time with you. They will talk with you through your financial situation and give advice on how you can tackle your finances. After assessing your situation, they will talk you through any debt solutions that suit your specific circumstances. Together, you can decide if you want to proceed with any of these.
What do I put on the online form?
To help our advisors understand your situation better, try to make your form as detailed as possible. You’ll have the chance to add or clarify details, but take some time on the form as well.
Where are bankruptcy orders made?
Bankruptcy petitions are presented in the High Court in London or at a county court near you. Not all local county courts will deal with bankruptcy petitions though.
What payments might I have to make during bankruptcy?
After looking at your income and expenses, the official receiver might decide you should make payments to your creditors. If asked to sign an ‘income payment agreement’, you will be committed to paying fixed monthly payments for up to three years. Any changes with your circumstances will need to be shared with the official receiver so adjustments can be made.
During bankruptcy, will I lose my house and/or car?
The bankruptcy process may involve giving up some or all of your assets. There are options like debt relief programs which may allow you to keep your assets. Your advisor will be able to talk you through the options and advise based on your individual case.
Is there a chance my credit rating will remain intact?
Unfortunately, most debt relief solutions affect your credit rating in some way. It may be impacted for up to six years and possibly more depending on the solution, so this is something important to think about.
What’s the difference between a secured and unsecured debt?
Secured debts use another asset as collateral. For example, mortgages or car loans. Whereas unsecured debts aren’t wrapped up in an asset - they’re just money. These include bank loans, credit cards, and overdrafts.
